Wednesday, White House Chief of Staff, Denis McDonough, announced that President Obama will “do audacious executive action over the course of the rest of the year” on guns and immigration and “any and all issues.”
Moreover, President Obama is daring the Senate to stop him. His Chief of Staff, discussed his plan to usurp “any and all” legislative power and said “the main question President Obama plans to ask himself is ‘Why not?”
Well, the answer to “why not” Mr. President, is that the Constitution kinda limits your power; you don’t have the power to legislate around the Legislative Branch, i.e., Congress. In fact, you don’t have to read very far into the Constitution to discover which branch has legislative power. The answer is right there in the first eleven words:
“All legislative Powers herein granted shall be vested in a Congress.” (Art. I, Sec. 1.)
Here’s a handy way to help remember which branch has legislative power: the name of the power (legisltative) – is also the name of the branch (legislative).
So what do we do now? Well, thankfully, other branches have powers and the ability to check and balance the President. But the question is: will they?
It is important for the Senate to to meaningfully “check and balance” this increasingly unconstitutional President, and one powerful tool at the Senate’s disposal is to simply refuse to consent to the confirmation of any more of President Obama’s judicial nominees. Americans will support this measure because they don’t want any more of Obama’s activist judges on the courts.
JAG detailed all of this Thursday in a letter to Senate leadership. The letter states that the Senate has already confirmed 320 of President Obama’s judicial nominees (23 more than President Bush had at the same time) and, overall, those nominees are doing great damage to the Constitution with rulings: (1) protecting pro-abortion-baby-body-parts-sale videos in California, (2) attempting to re-define marriage by judicial fiat well before the U.S. Supreme Court’s anti-constitutional ruling in Obergefell, and (3) forcing tax-payers to fund irreversible sex-change surgeries upon misled prisoners. Please call your Senators now and encourage your Senators to stop confirming Obama judges. You might want to keep a copy of the JAG letter handy when you call so that you can provide them with details.
