Scholars Question SCOTUS Gay Marriage Decision

A recent statement released by a group of scholars calls into question the legitimacy of the Supreme Court opinion with respect to marriage. We’re going to be talking about an article by Jerry Newcombe entitled, “Have We the People Stopped Being Our Own Rulers.”

Mat Staver: Matt, Jerry Newcombe’s article appears in and he talks about this release of the statement and it’s a statement calling for constitutional resistance to Obergefell v. Hodges. That is the Supreme Court opinion that was issued on June 26 by five lawyers on the Supreme Court.

The statement begins by saying, “We are scholars and informed citizens deeply concerned by the edict of the Supreme Court of the United States in Obergefell v. Hodges wherein the Court decreed, by the narrowest of margins, that every state in the country must redefine marriage to include same-sex relationships.”

They go on to say that, “If Obergefell is accepted as binding law, the consequences will be grave.” And indeed, they will be grave.

Matt Barber: That’s right. He gives — Newcombe does — a summary of the consequences those scholars present:

*Denigration of the time-honored building block of society, and the best means for bearing and rearing children
*Dissent against same-sex marriage will be punished
*It opens Pandora’s Box on what constitutes a marriage
*The decision undermines “we the people…”

…because it engages this idea of Judicial Supremacy,” something Thomas Jefferson and other founders…Andrew Jackson and others, warned about, that says basically that if a majority, at least five of nine Supreme Court justices says it’s so then it’s so. Well that’s not a democratic republic; that’s an oligarchy.
