Oral arguments are now set in the case involving Chief Justice Roy Moore. The case will be heard early August in Alabama.

Mat Staver: Matt, this case should have never been initiated in the first place. We know that it’s been politically motivated because it has no substance, and we believe we have a strong case to get this entire matter dismissed. The problem, however, is, in Alabama, as soon as a charge is ultimately filed, no matter how bogus it is, automatically the judge or the justice is removed from the bench. So, meantime, while this case is going on, Chief Justice Roy Moore is not sitting in the Chief Justice’s seat on the Supreme Court of Alabama.

Matt Barber: Right. So the process automatically becomes part of the penalty, even though it’s completely trumped up and the SPLC knows that this is politically motivated, that it has no basis in fact or law. And in fact I know LIberty Counsel is challenging this rule that says that a judge or justice, in this case a Chief Justice…
