ACLU Requests Class Action on Moot Case

A legal case is moot when a situation changes and plaintiffs claiming to be hurt are no longer in that same situation. Such is the case with the lawsuit against Kim Davis, the Kentucky clerk who refused to issue same sex marriage licenses.
But now the ACLU, not wanting to dismiss their case, wants to have the case considered a class action lawsuit of people who are coming in some distant future to get a marriage license.
Liberty Counsel has filed a response opposing the ACLU’s request. There is a very high bar prior to granting a class action in any case, let alone this one.
